Nursing Home Admission Agreements

Placement of a loved one in a nursing home is often a stressful event. During the admission process, the individual and his or her family may not fully appreciate the significance and legal effect of the nursing home admission agreement, or contract. The family may feel rushed to complete the necessary admission paperwork.

Admission agreements are governed by federal and Minnesota law and Minnesota law allows nursing homes to request someone to sign the contract as a “responsible party.” The law, however, does not require a “responsible party” to sign the agreement as a condition of the resident’s admission.
