Mediation and Arbitration

Attorney Randy F. Boggio is a qualified neutral under Rule 114 of the Minnesota General Rules of Practice and is able to act as a mediator or arbitrator in probate and trust litigation, guardianship and conservatorship issues and Elder Law matters.

Alternative Dispute Resolution (ADR) is a process of trying to settle disputes before going to court. A “neutral” is an independent third party who is specially trained to help resolve the dispute. In arbitration, each party presents their case to a neutral party who then makes a decision. If the parties agree, arbitration allows the neutral third party to make a binding decision that is enforceable.

In mediation, the neutral third party helps facilitate communication between the parties allowing the parties to reach an agreeable settlement.
